Welcome to John Dunne Photography. These Terms and Conditions govern the purchase of fine art prints, gift certificates, image licences, commissioned photography, and tuition services provided via johndunne.ie.
By engaging our services or purchasing products, you confirm that you have read, understood, and agreed to these Terms.

1. General Principles and Definitions

These Terms form a single, integrated legal agreement between you and John Dunne Photography.
Specific written agreements, such as quotations or invoices, may supplement these Terms and will prevail regarding the specific matters they address.

  • Bespoke Nature: You acknowledge that all products and services—including prints, licences, commissions, and tuition—are bespoke and tailored to specific requirements.
  • Business vs. Consumer: While mandatory consumer protections under Irish and EU law apply to individuals, certain statutory rights (such as cooling-off periods for non-bespoke items) may be limited in Business-to-Business (B2B) transactions.
  • Communication: “Written” agreements include email correspondence, proposals, and invoices.

2. Intellectual Property and Licensing

Copyright in all images, commissioned work, and teaching materials remains the exclusive property of John Dunne Photography.

  • Licensing: Image licences are granted on a Rights Managed basis for specific, agreed uses only. Any additional or expanded use requires a new licence.
  • Transfer of Rights: No rights are granted until the licence terms are agreed upon in writing and full payment is received.
  • Finality of Digital Delivery: Due to the nature of Rights Managed licensing and immediate delivery, fees are non-refundable once the image has been supplied.
  • Private Display: Purchasing a physical print grants the right to private display only; commercial use or public display is prohibited without a separate licence.

3. Fine Art Prints

Prints are supplied as fine art giclée prints using archival materials and are personally inspected and signed.

  • Returns & Refunds: A 90-day satisfaction guarantee is offered for prints returned in “new condition”. You are responsible for the cost and risk of return shipping.
  • Damage in Transit: Damage must be reported within 7 days with photographic evidence of the print and packaging to qualify for a replacement or refund.
  • Risk and Title: Risk of loss stays with the photographer until delivery, at which point title passes to you.
  • International Orders: For deliveries outside Ireland or the EU, the buyer is responsible for all local import duties and taxes.
  • Lifetime Warranty: Prints are warranted not to fade under normal display conditions for as long as you own the print.

4. Photography Services (Commissions & Tuition)

These services are provided with professional care; however, outcomes often depend on external factors such as weather and light.

  • In-Field Safety: Outdoor tuition involves inherent physical risks. Participants accept full responsibility for their own safety, fitness, and equipment.
  • Weather & Flexibility: The photographer reserves the right to modify, reschedule, or cancel sessions where conditions are unsuitable or unsafe.
  • Cancellations (Commissions): If a commission is cancelled after work has commenced, fees for work completed and non-recoverable expenses may be charged.
  • Cancellations (Tuition): Participants are requested to provide 7 days’ notice for rescheduling. Fees may be retained for late cancellations.
  • Payment: Tuition and mentorship are payable in full in advance. Commissions follow agreed project-specific payment schedules.
  • Gift Certificates: Valid for five years. They are non-refundable after 14 days and cannot be exchanged for cash.
  • Liability: Liability is limited to the fees paid for the specific product or service, except where liability cannot legally be limited.
  • Governing Law: These terms are governed by Irish law. Mandatory consumer protections in your country of residence continue to apply where required.
